Neuroscience versus the control of emotions with cognitive strategies during the judicial process

Abstract

The impressive advance presented by neuroscience leads to a revolutionary scientific event on how to administer justice based on the control of emotions, thus modifying traditional models through the generation of innovative didactic-legal strategies in the judicial office. The objective was to investigate the control of emotions from neuroscience, based on the discernment and intellect of the magistrates in their procedural development, based on cognitive strategies which affect the process from the judicial office. The methodology was a structured bibliographic review, with a phenomenographic design of thematic analysis, under the hybrid prism method, with non-probabilistic sampling and with inclusion and exclusion criteria from the search of 20 articles from the open access databases of Scielo, Scopus, Proquest, WOS. Among the main results is a legal and controversial position; concluding that neuroscience with didactic strategies is useful to law, since it makes possible the qualification of human behavior in an optimal way, facilitating the work of the judicial office and the administration of justice.
