    Abstract

    Custody is an institution of Family Law aimed at the protection of children. If the parents do not reconcile to obtain custody and visitation, the Peruvian Judicial Power, through the Specialized Family Judge, determines who will exercise custody through a psychological profile study, of a forensic nature. The effectiveness of the psychological evaluation has allowed, in several cases, to identify personality disorders on the part of the parents and sexual indemnity of the minor, generating criminal consequences with those people who have violated the best interests of the child. It is argued that this experience-with its limitations-is concatenated with other situational policies tested or designed, such as those related to crime reduction, assisted death and social prediction, also efficient or potentially more efficient than the traditional ones. It is argued that the figure of psychological evaluation is situational and recovers the central function of science and intelligence resources in social sciences, for the establishment of legal truths. Therefore, the study of the situation, from a situational perspective, contributes efficiently to the development of criminal and public policies in general.
