Resumen
The research analyzes the Civil Responsibility of the democratic State as a contribution that allows the organization of fair societies. It is a bibliographical study from the descriptive rationalist approach. Considers the impossibility of judging the magistrate who deliberately breaks the law to harm the dignity of the court. Thus, the importance of correctly regulating the jurisprudence in favor of carrying out processes attached to the interest of the correct actions as a correlate of the best coexistence is insisted on. It deals in Latin America, highlighting the Peruvian procedural provision, to form democratic governments as a manifestation of human rights. Optimum coexistence occurs by repealing privileges before the law by virtue of maintaining equality, equity and justice.
