Una mirada a la actuación de los magistrados civiles del Perú y la aplicación del principio de predictibilidad

The main objective of this article is to determine whether the principle of prohibition of arbitrariness is actually applied in the actions or interventions of the competent authorities in accordance with the procedural time limits stipulated in article 124 of the Civil Procedure Code. To this end, this article is based on two essential premises for this investigation: 1. The principle of prohibition of arbitrariness, which is considered as that prohibition instrument aimed at preventing the emergence of unjust, arbitrary or abusive provisions or norms in our legal system that do not have any reasonable or logical basis. 2. The procedural time limits, which are the legal precepts stipulated in article 124 of the Civil Procedure Code, where certain time limits are determined for the purpose of the authority that executes justice, in this case the civil judge, declaring its resolutions in a process. The method used in the development of this research was basic, where it was carried out based on a qualitative approach, and it also took grounded theory as a design or structure, and interviews were used as collection techniques. It is concluded that the Principle of Prohibition of Arbitrariness and the deadlines indicated in article 124 of the Civil Procedure Code are not currently being applied.
